Terms and Conditions

Aphrodonis Media Group Ltd, hereinafter referred to as "Dialando", publishes the following terms and conditions:

The following terms and conditions apply exclusively to the ordering and sending of goods that the customer [private end consumer] orders on the Internet via online shopping. With an order these AGB are recognized.

1. Conclusion of contract

The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. After entering your personal data and by clicking the button "Buy" in the final step of the ordering process, you place a binding order to purchase the goods in the shopping cart. The confirmation of receipt of the order follows immediately after sending the order by email and SMS. The purchase contract is concluded with our order confirmation or delivery of the goods.

A phone order is currently not possible! However, if you need help with a product or if you have problems placing an order, you are welcome to contact us at any time.

2. Contract text

Your order data will be stored by us and can be viewed by you in your customer login area, even later. As soon as you have placed an order with us and have not created a password and customer account yourself, our store system will automatically create a customer account for you. A password will be created automatically and sent to you by e-mail. Of course, only you know this password. You can change the password at any time in your customer account!

You will also receive a summary of your order data by e-mail. If you do not receive this e-mail, due to possible incorrect entries, please contact our customer service! Please also take into consideration the possibility that the e-mail may have gotten into your spam folder.

3. Revocation instruction

Right of withdrawal

You have the right to cancel this contract within 14 days without giving reasons. The revocation period is 14 days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the last goods. In order to exercise your right of withdrawal, you must inform Dialando of your decision to withdraw from this contract by means of a clear statement (e.g. a letter, fax or e-mail sent by post). The easiest way to do this is to contact us using the contact options listed on our contact page!

If you make use of this option, we will immediately (e.g. by e-mail) send you a confirmation of receipt of such a revocation. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.

Please don't forget to send us your order number, which you received with the sales contract!

Consequences of withdrawal

If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (with the exception of any additional costs resulting from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than thirty days from the date on which we receive notice of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any event no later than thirty days from the date on which you notify us of the cancellation of this Agreement. This period shall be deemed to have been observed if you send the goods before the expiry of the thirty-day period. You bear the direct costs of returning the goods to our warehouse in Germany, unless a local warehouse has been announced! You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

5. Delivery and returns

The delivery is either ordered by Dialando itself or, in exceptional cases, carried out by a supplier. If the customer does not accept the goods or refuses to accept them despite a deadline set by Dialando, the owner of Dialando (see imprint) can choose to withdraw from the contract. The valid shipping costs can be found in the menu item Shipping Costs under Information. For possible returns, please use the original packaging if possible or an equivalent shipping packaging that guarantees sufficient protection of the goods.

6. Transport damage

If goods with obvious transport damages are delivered, please complain about such errors as soon as possible to the deliverer or where you pick up your parcel and contact us immediately, at the latest within 7 calendar days. Your rights as a consumer, especially your right to warranty, remain unaffected. You help us to be able to assert our own claims against the carrier or the transport insurance company.

7. Set-off

The customer can only offset against such claims that have been legally established or are not disputed by the owner of Dialando (see imprint). The customer only has a right of retention for claims arising from the same contractual relationship.

9. Payment

The purchase price is due immediately upon receipt of our order confirmation, unless you placed the order through a payment service provider that offers "payment on account". The customer can pay the purchase price by bank transfer to the account indicated in the order confirmation, by Paypal or by credit card. The total price indicated in the order confirmation must be paid. All prices already include the obligatory value added tax, which is different in every country. The owner of Dialando (see imprint) is obliged to pay the legal value added tax legally upon conclusion of the contract.

On the order confirmation or order confirmation, VAT is not shown for technical reasons, but it contains the note "Price incl. statutory VAT". If you need an invoice with shown VAT, please contact us!

In general, sis remains the property of Dialando for full payment. For further details on payment methods, please refer to the menu item Payment Methods under Information.

10. Guarantee, warranty and after-sales service

Unless otherwise expressly agreed, the statutory liability for defects shall apply. Information on individual manufacturer warranties can be found in the product documentation. Whether a claim to a manufacturer's warranty is given, you can find out on the product pages within the description. You can reach our customer service here!

11. Exchange return

Shopping without risk, no problem with us! Due to the legally established right of revocation, you can also return goods that you do not like as originally intended. Please read below what you should consider in case of a return.

Our request to you!

Please do not treat our goods that you wish to return like your property to avoid deterioration of the new condition.

Already when opening the packaging, you can avoid damage to the shipping and product packaging or the product itself by carefully unpacking it. This is especially true for larger objects such as watch winders and watch boxes, because to return these items safely, it is best to use the original packaging.

Leave e.g. protective foils on the watch, band or jewelry part and do not remove them if possible. Do not use goods that you will probably return. For example, we would have to change leather straps after a short period of wear for hygienic reasons. Steel straps show first surface scratches on polished surfaces very quickly, this has to be laboriously polished or replaced in order not to disappoint the next customer.

Mechanical watches that you want to test for accuracy, please test for example in a watch winder, time scale at the watchmaker or by manual winding, and not by "test wearing" on the wrist.

We thank you for your attention and caution in this regard and appreciate it very much!

Returns

Please note the following points when returning goods:

Before you return an item to us, we ask you to contact our support to register a return! Our customer service will then send you an already filled out return form, where you will also find the return address. 

Pack the item you want to return completely and together with any accessories that may be included. To avoid transport damage, we recommend that you use the original packaging.

Put the return form you received from us into the package. This will speed up any refunds or exchanges considerably.

Which service provider you choose for the return shipment is up to you. In your own interest, please make sure that the shipment is insured and traceable (insured package). In addition, we will give you the option of us taking care of the return of the package. In this case, the costs for the return shipment will simply be deducted from the refund amount. 

Please avoid freight forwarder shipment returns, we will charge the costs incurred (currently 15.00 Euro for DHL) in case of a refund!

Exchange

You would like to return one or more items, but would like to receive one or more other items in return? Please note your wishes in this regard when you contact our customer service regarding the return shipment! 

At Dialando an exchange for other goods is also possible beyond the 14-day right of withdrawal within 30 days after delivery, provided that the goods are unworn. This regulation does not represent a limitation of your rights as a consumer, but an extension of them.

If an exchange requires an additional payment (new goods are more expensive than the returned ones), a service employee will inform you as soon as the return has reached us.

Refund

In the event of a refund, the money will be booked back the same way we received it. For example, if you purchased with a credit card, the payment is simply cancelled and the card issuer books your payment back! 

In case of a credit note, we ask you to provide us with your IBAN and BIC or your local bank account number in order to transfer the credit amount!

12. Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options for certain countries. The payment is always made to Klarna:

Invoice: The payment period is [14] days from the date of shipment of the goods/tickets/ or, in case of other services, from the date the service is made available. The complete invoice terms for the countries where this payment method is available can be found here: Germany, Austria.

Installment purchase: Klarna's financing service allows you to pay for your purchase in fixed or flexible monthly installments according to the conditions specified in the checkout. Payment in installments is due at the end of each month after Klarna sends you a monthly invoice. For more information on installment purchases including the General Terms and Conditions and the European Standard Consumer Credit Information for the countries where this payment method is available, please click here (only available in the countries indicated): Germany, Austria.

Sofortüberweisung: Available in Germany, Austria, Belgium, Italy, Spain, Poland and the Netherlands Your account will be debited immediately after placing the order.

direct debit: The direct debit is made after the goods have been shipped. You will be informed about the time by e-mail.

Credit Card (Visa/Mastercard): Available in Germany. The debit is made after the goods or tickets have been shipped / the services are available or, in the case of a subscription, according to the communicated times.

The use of the payment methods invoice, installment purchase and direct debit requires a positive credit check. In this respect, we will forward your data to Klarna for the purpose of address and credit assessment in the context of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permitted based on the results of the credit check. Further information and Klarna's terms of use can be found here. Your personal data will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna's Privacy Policy.

13. Note on battery regulation

In connection with the sale of batteries or rechargeable batteries or with the delivery of watches or other devices containing batteries or rechargeable batteries, we are obliged to inform you of the following in accordance with the battery regulation: Batteries or rechargeable batteries may not be disposed of in household waste. You are legally obligated to return used batteries or rechargeable batteries as end user. You can return batteries or rechargeable batteries after use at the point of sale or in its immediate vicinity (for example, at municipal collection points or in the trade) free of charge. You can also return batteries to us by mail. Batteries or rechargeable batteries that contain harmful substances are marked with the symbol of a crossed-out dustbin. Near this dustbin symbol is the chemical name of the pollutant. Cd stands for cadmium, Pb for lead and Hg for mercury.

14. Place of performance, place of jurisdiction

For all present and future claims arising from the business relationship, the exclusive place of jurisdiction for merchants is the registered office of the seller. Place of jurisdiction and place of performance for merchants is Paphos, Cyprus.

15. Dispute resolution

The European Commission provides an online dispute resolution (OS) platform, which you can find here. Consumers have the possibility to use this platform for the settlement of their disputes. In order to settle disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute settlement proceedings before a consumer arbitration board. Responsible is the general consumer arbitration board (from 01.01.2020: the universal arbitration board) of the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in dispute resolution proceedings before this office.

16. Final provisions, severability clause

Should one or more provisions of these GTC (General Terms and Conditions) be invalid, this shall not result in the invalidity of the entire contract. The ineffective provision will be replaced by the applicable statutory provision. Only Cypriot law is applicable to this contract. For customers from Spain, however, the irish law!
